New rules for long-term rental

A new law that regulates the Basic Housing Law, published on November 3, will regulate housing advertisements, ensure the protection of consumers in housing need as well as the monitoring of housing conditions.

Advertise a rental

From now on, rental advertisements promoted by real estate companies must mention the number of the residence permit or authorization to use the property, including the number of bedrooms and the floor space, and as advertising entities they must also remove any posted ad. without the indication of these elements.

Anyone who does not comply with these new requirements is liable to a fine of a maximum amount of € 3,740 (for individuals) and € 44,890 (for companies).

Protection of consumers in need of housing

The new law also expands the notion of housing need, as people living in housing need anyone who does not own property or those who are at risk of losing suitable housing.

This law also stipulates that the various state and municipal entities must work together to resolve the situations of people in need of housing, in order to provide solutions for permanent or temporary housing, depending on each individual’s specific situation.


This legal document also extends the inspection powers of Instituto da Habitação and da Reabilitação Urbana (IHRU) in real estate rental. However, this activity will be subject to a prescription which will be approved within 30 days.

DECO considers that the approval of this bill is indeed a step forward in order to ensure a better balance in the housing market.

However, DECO believes that this is not enough, as much remains to be done in this sector, in particular the development of policies ensuring: universal access to housing; strengthening of the law aimed at promoting a balanced relationship between tenants and owners; greater inspection of the rental market in terms of contracts; measures that guarantee the quality of life of owners and tenants through rehabilitation programs and construction work on their homes, in order to fight against fuel poverty, etc.
